The FCC states that anything that transmitts RF over 500mW output power must be approved, for private or public use, regardless of frequency. (I can find my FCC-Part 95- rules and regs manual if necessary). Personally, if you build ANYTHING that doesn't bother anyone else, except within the confines of your property, it SHOULD be ok to use.
